Undue influence

Undue influence occurs when someone uses pressure to encourage, cajole or force you to make or update your will.  This is not legal and your will could be subject to legal challenge if undue influence can be proven.

Pressure includes physical, emotional, or financial pressure.  A rule of thumb is: if you do not feel okay when you are making your will – it is not okay. If you are worried for the safety of yourself or another you should contact the Police as soon as it is safe to do so.  You may also want to speak with a solicitor face to face to protect your wishes.

If you are subject to undue influence we suggest that you revoke or update as soon as it is safe and practical to do so.  You may wish to choose a professional executor for added protection.
